Apple Watch ban paused by appeals court; Apple can sell devices again
The Apple (NASDAQ:AAPL) Watch sales ban was paused by a U.S. appeals court.
The company requested a pause until January 12 pending a U.S. customs decision on whether a redesigned version of the devices falls outside the scope of the International Trade Commission’s remedial orders.
Update: According to Bloomberg, both the Apple Watch Series 9 and Ultra 2 smartwatches will return to Apple stores by the end of the day and Apple’s website by 12 p.m. PST tomorrow.
Masimo (NASDAQ:MASI) shares fell 5% on back of the news, while Apple slipped 0.6%.
The importation and sale of some Apple Watch models was banned effective December 26 after the Biden administration declined to veto a decision by the International Trade Commission.
The ITC determined earlier this year that Apple uses a blood oxygen technology that infringes on patents held by Masimo. The government could have vetoed the ITC decision by December 25. The oxygen feature has been included in some watch models since 2020.
Despite the ban, the watches were still be sold by third parties like Best Buy.
Last week, Apple paused sales of its Series 9 and Ultra 2 smartwatches.
Apple’s wearables, home and accessory business, which includes the Apple Watch, brought in more than $8.2B in sales in the third quarter, out of a total revenue of $81.8B.
